Terms of Service

These Terms of Service ("Terms") govern use of the CanYouSell platform at canyousell.xyz (the "Service"). By creating an account or using the Service, you agree to these Terms. If you use the Service on behalf of a company, you represent that you have authority to bind that company. We may update these Terms from time to time; continued use after changes take effect constitutes acceptance.

The service

CanYouSell lets companies create AI-powered voice sales assessments, invite candidates through email invitations or shareable links, and review recordings, transcripts, scores, call metrics, and AI-generated feedback and hiring recommendations. Candidates complete assessments free of charge.

Accounts

You must provide accurate information and keep your credentials secure. You are responsible for activity under your account, including activity by teammates you invite to your workspace. Candidates verify their email address with a one-time code before starting an assessment.

Fees and billing

Some features require a paid subscription, billed through our payment provider, Dodo Payments. Current fees and plan limits are shown in the product before you purchase. Subscriptions renew automatically until cancelled; you can cancel at any time, and access continues until the end of the billing period. Fees already paid are non-refundable except where required by law. Usage limits apply to protect the platform, and we may pause usage beyond those limits.

Acceptable use

You agree not to:

• Use the Service in violation of any law, including employment, anti-discrimination, and data protection laws;
• Invite candidates without a genuine hiring or evaluation purpose, or misrepresent what the assessment involves;
• Share, resell, or automate access to assessment links, or circumvent usage limits;
• Attempt to probe, disrupt, or gain unauthorized access to the Service, scrape it, or use it to build a competing product.

Recording and candidate consent

Assessment calls are recorded, transcribed, and analyzed by AI, and the results, including the recording, are shared with the company that issued the assessment. Candidates are informed of this before the call and consent by starting an attempt. Companies must present assessments honestly and must not hide or misrepresent the recording and AI analysis.

AI output and hiring decisions

Scores, feedback, and hiring recommendations are generated by AI and are advisory. They can contain errors and must be used as one input among several in a hiring process, never as the sole basis for an employment decision. You are responsible for ensuring your use of assessment results complies with the laws that apply to you, including any laws governing automated or AI-assisted employment decision tools in your jurisdiction, and for obtaining any candidate consents those laws require.

Your content and data

You retain ownership of the content you provide, including assessment briefs, buyer personas, candidate data, and internal notes. You grant us the rights needed to host and process that content to operate the Service. We may use aggregated, de-identified usage data, such as platform-wide average scores, to provide benchmarks and improve the Service. The Service itself, including its software, design, and branding, remains ours.

Disclaimers and liability

The Service is provided "as is" and "as available", without warranties of any kind. We do not warrant that the Service will be uninterrupted or error-free, or that AI-generated output will be accurate. To the maximum extent permitted by law, we are not liable for indirect or consequential damages, and our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose, or USD $100 if you have paid nothing.

Termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms or to protect the Service, its users, or third parties.
