Terms of Service

These Terms of Service ("Terms") govern your use of the CanYouSell platform at canyousell.xyz (the "Service"). By creating an account or using the Service, you agree to these Terms. If you use the Service on behalf of a company, you represent that you have authority to bind that company.

The service

CanYouSell lets companies create AI-powered voice sales assessments, invite candidates to complete them, and review recordings, transcripts, scores, and AI-generated feedback. Candidates invited by a company may use the Service to complete assessments without a subscription.

Accounts

You must provide accurate information when creating an account and keep your credentials secure. You are responsible for activity that occurs under your account. We may suspend or terminate accounts that violate these Terms.

Subscriptions and billing

• The free plan includes limited monthly assessments. Paid plans (Starter, Growth) are billed monthly in advance through our payment provider, Dodo Payments.
• Plan limits (assessments per month, candidates) apply as described on the pricing page.
• You can cancel at any time; access continues until the end of the current billing period. Fees already paid are non-refundable except where required by law.
• We may change pricing with reasonable advance notice.

Acceptable use

You agree not to:

• Use the Service in violation of any law, including employment and anti-discrimination laws;
• Invite candidates without a genuine hiring or evaluation purpose;
• Attempt to probe, disrupt, or gain unauthorized access to the Service;
• Resell or misrepresent the Service, or scrape data from it;
• Upload content that is unlawful or infringes others' rights.

Hiring decisions and AI output

Assessment scores and AI-generated feedback are advisory tools. They can contain errors and should be used as one input among several in a hiring process — not as the sole basis for an employment decision. You are responsible for ensuring your use of assessment results complies with the employment, data protection, and automated-decision-making laws that apply to you, and for obtaining any candidate consents those laws require.

Candidate consent to recording

Assessment calls are recorded, transcribed, and analyzed by AI, and the results are shared with the inviting company. By starting an assessment, candidates consent to this processing. Companies must not invite candidates in a way that hides or misrepresents this.

Your content

You retain ownership of the content you provide (assessment briefs, personas, candidate data). You grant us the rights needed to host and process that content to operate the Service. We may use aggregated, de-identified usage data to improve the Service.

Intellectual property

The Service, including its software, design, and branding, is owned by CanYouSell and its licensors. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service.

Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated output will be accurate.

Limitation of liability

To the maximum extent permitted by law, CanYouSell will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim arising out of the Service is limited to the amount you paid us in the twelve months before the claim arose (or USD $100 if you have paid nothing).

Termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms or to protect the Service, its users, or third parties. Sections that by their nature should survive termination (such as limitations of liability) do so.

Changes to these terms

We may update these Terms from time to time. We will post the updated version here and revise the "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance.
